Site-specific – planning appeal stage

Our client, a local authority, wished to challenge a developer’s affordable housing provision. We carried out a detailed review, then acted as expert advisers representing our client at the appeal hearing. We successfully supported the Council’s case to the Inspector, who ruled that the developer’s proposed approach to affordable housing was inadequate.

In other, similar cases, we’ve conducted detailed viability analyses of the developers’ assumptions, then successfully defended S106 BC Appeals, and helped to enforce the full affordable housing contribution on schemes.

Following our viability assessment review work and subsequent negotiations during an appeal through Public Inquiry, we secured circa. £300,000 additional affordable housing enabling funds on a retirement housing scheme, effectively doubling the original offer.
